The Chicago judge who last week dismissed a class-action suit filed against Creed by four disappointed fans has given the plaintiffs one last chance.

Circuit Court Judge Peter Flynn dismissed the case "with prejudice," which means the fans' attorney, Daniel Voelker, can amend the suit and refile within 30 days. Flynn also offered an alternate way to approach the complaint. "He thought that if the case proceeds at all it should be on a basis of 'frustrated commercial expectations,' " Voelker said. "It's unusual for a judge to give what might be viewed as legal advice."

Creed attorney Rob McNeely had a different take on the judge's decision. "He absolutely gutted their lawsuit. He said to their lawyer, 'You're asking judges to become rock critics. You're asking us to decide what's a good show and what's a bad show, and that's no business of the judiciary.' And he said, 'If I were to agree with you, it would have a chilling effect on the arts.' "

The fans' suit claimed the band should be held responsible for a December show in which frontman Scott Stapp allegedly appeared drunk, had trouble singing and passed out (see "Sloppy Creed Show Has Fans Suing For Refunds"). Stapp later said he was simply being dramatic (see "Creed Singer Defends 'Symbolic, Personal Gesture' He Made At 'Drunken' Show"). The suit asked the band to refund ticket and parking costs for all 15,000 fans who attended, at a cost of about $2 million.

In its reshaped form, the suit will target Creed for failing to deliver the kind of professional, high-quality performance fans have come to expect. The suit will again allege that Stapp appeared to be intoxicated, was unable to sing properly and passed out.

"Creed have this reputation in the industry as being a band you can count on," Voelker said. "They don't act in a manner you'd expect from Jim Morrison, Janis Joplin or Jimi Hendrix. So by being intoxicated during a performance, concertgoers are entitled a claim for relief."

Voelker said there is legal precedent to back up his complaint, citing a case in which a man sued a painter who had been commissioned to paint a portrait of his wife. The painting didn't look like the woman, so he sought to recover the fee. The defendant argued that since he was an artist, appreciation of his work was a matter of artistic interpretation. A judge disagreed.

"The lead singer was in a condition he shouldn't have been in onstage," Voelker said. "It's analogous to an opera singer having laryngitis and performing anyway. The audience did not get what it was entitled to."

McNeely said that claim holds no water. "He already tried using that argument in the original case and the judge dismissed it," he said. "At a concert there's no contract between artist and ticket holders. A ticket is just a license to be able to go into an arena and be there to the exclusion of somebody else. It's a license to use a premises. It's not a license of a quality performance. It's not even a guarantee that someone's gonna play."

In his original suit, Voelker basically claimed Creed had breached their contract by playing a terrible show and that a substandard performance was tantamount to a cancellation. That contention didn't hold up because Judge Flynn agreed with the defendants' claim that as long as they took the stage, Creed could play one note, thank the crowd and walk off and it would hold up as an appearance. The decision was based on a previous case in which a judge determined that fans couldn't sue the Chicago Cubs for having a bad season.

McNeely said even if Voelker rejiggers his lawsuit, his clients will no longer be able to file a class-action suit because such a case requires everyone involved to have experienced the same loss for the same reason, and there's no way to prove that all 15,000 members of the crowd were unhappy with the show.

"What Judge Flynn did is take a $2 million case down to a $227 case," the amount Voelker's four clients paid for tickets and parking, McNeely said. "And he did if for defense of the arts. We're very pleased with his decision."

I just seen a segment on CJ (Celebrity Justice) on this. It is so ridiculous because they aren't suing a "band" for performing badly. They are suing because "this" band was bad, because in the past they were so honest and came out and said this was a honest release for Scott because of his childhood. COME ON!!!

Like I said in an early post let me go sue GNR! It doesn't look like it's getting to him too much from what I saw on the interview. He's pissed because it's making his reputation look bad! Hopefully this will all blow over and they can get back to doing other things!!;)

Thanks, Joy. I think it's from the opening night concert of the Weather tour. I know, I can't wait to see them either!! I hope they're not letting all of this stuff get to them but I hope they realize how many of us support them.

Kris, I agree, I want all of this to be over real soon too, like yesterday.

Actually Julie, I was offended, as I am fat. And I eat fast food a lot, but I'm not retarded. But I do accept your slightly less than profound apology and I believe you're truely remorseful. As for the lawsuit, as a Fan, and I use the term loosely because though I love the music and and songs and performances(i've thrice been to Creed concerts), I don't follow the Band around, or purchase magazines because a Creed article is present nor do I purchase their CD's with any regularity, I think a lawsuit was the only recourse for these concert goers. They asked the band for their money back and recieved an apology letter that basically said they should be thankful and feel honored to have been in attendance at such a historical moment for the band. Allow me to side step this for a sec...If you go to any large chain movie theatre, watch a movie and find that it stunk or that it wasn't what it should been, as it was hyped up to be, or even if there was a crowd of unruly kids or people with babies or celphones, you can ask the theatre management for a refund and invariably you will get a refund or at least a free ticket to another performance to be used at a later date. The same situation should apply here. Give the people a refund or at least a free ticket to another performance. Look what it comes down to is accountability. The band had a responsibility to professionally perform a show and failed to meet a minimally acceptable level of said professionalism and when called on it turned lemonade into lemons by underestimating the dissatisfaction of the fans. Think about it, this is a situation where for want of teaspoon of water the forrest was lost. All Creed needed to do was Refund 230 bucks. I think my first Creed concert cost me 250 bucks(for two tickets! Thanks Ebay!) The Band should fire whatever moron wrote that shameful apology letter. At this point, the best thing the Band can do is reverse the flow. Turn lemons back into lemonade and do it in full public view as soon as Scott finishes 28 days in an inhouse 12 step program. How do they do this? For starters, a hand written letter of apology, followed by an all out personal invite to a show, including roundtrip airfare, backstage passes, all meals/drinks comped, front row seats and a limo to and from the nearest 5 star hotel. Now instead of 230 bucks, it'll cost the band about 5,000 bucks, but thats still better than dragging this through the courts and seeing the bands name and Scott personally dragged through the mud. And, if nothing else, it's allowing the band to be accountable and the fans satisfied. IMHO of course.

It will never go away. I was there, saw it all, and am still a fan. I survived it and most certainly didn't feel the need to sue. Yes, the apology letter was poorly written and whomever wrote it should have been kicked in the ass. You also have to keep in mind that these people wanted more than their money back to begin with and when they were denied, they tried to bring class action suit against the guys.

I can't beleive these people are going this freaking far. Okay, you spent $50.00 bucks for a ticket, and $10.00 bucks on parking. The time they've spent pursuing this has cost well over $60.00 bucks......my time is the most precious thing to me (besides my 2 kids), I wouldn't waste it on trying to get $60.00 bucks back for a concert I didn't like. The best way to get back at CREED is not buy there cds, or attend any more of their concerts. GET OVER THIS ALREADY!!!!!!!!

Hey everyone,

Yeh, whoever's pursuing this lawsuite should definitely give it up. When you go to a Creed concert, you pay to see Creed, and the fans that were there saw Creed, no matter how intoxicated Scott Stapp was, or how dodgy the performance was.

Oh well.

I think I've visited this topic more times than I've told my kids to brush their teeth. The one thing I wasn't so sure about was when I heard on Celebrity Justice that Creed was asking for an apology. That might be taking it a bit far on their end. Had I not seen the concert, I wouldn't make that judgment. I think it should just be over! I'm starting to get psyched for the next tour. It's getting closer. This year has gone fast. I miss that adrenaline rush!
